In this case the appellant seeks to have this court review and reverse the decision of the Commissioner of Patents, who refused *1064to revive appellant’s application for improvements in wireless receiving systems, filed October 19, 1923. Petitioner sought to have the Commissioner of Patents revive the application under the authority granted in section 4894 of the Revised Statutes, 35 U. S. C. A. ■37, the pertinent portion of which is as follows:
