This appeal arises from a professional liability case brought by Plaintiff Jeffrey Higginbotham, a former patient of Defendant Thomas A. D’Amico, M.D., a board-certified thoracic surgeon employed by Defendant Duke University Health System, Inc. (“Duke”).
