Statement of the Facts

Plaintiff Michel LaChance brought this action seeking to recover the sum of $49,-000 in United States currency which was forfeited to the United States after seizure by the Drug Enforcement Administration (“the DEA”). Plaintiff had unsuccessfully petitioned the DEA for remission or mitigation of the forfeiture, which petition was denied initially and upon reconsideration.
