This is an action upon a promissory note in the sum of $500.00 executed and delivered by the defendant, to One R. T. Bristol. The note bears date May 23rd, 1922, and is payable November 21st, 1922,

In its complaint the plaintiff alleges that “before the maturity of said note tbe payee therein for value assigned, transferred and delivered” the same to tbe plaintiff; and that “the plaintiff is still the owner and holder” thereof and that “no part thereof has been paid.”
