INGRAHAM, District Judge.
The case is before the court on defendant’s motion renewing its motion for directed verdict and for judgment, and, alternately, for new trial. The motion will be denied on all the grounds urged by defendant.
As its first ground for judgment or new trial, defendant maintains that the clear weight of the evidence does not support the jury’s findings that plaintiff has sustained 301 weeks of continuous, total incapacity since February 13, 1957, but rather that it conclusively establishes that plaintiff has not sustained any total incapacity since May 9, 1957.
