Plaintiff-Appellant Daphene Pelletier brought suit against her employer, Defen-danb-Appellee Yellow Transportation (“Yellow”), alleging federal and state law claims of sex discrimination, age discrimination, and whistleblower retaliation. Yellow moved for summary judgment for lack of subject matter jurisdiction and to compel arbitration, based upon an arbitration clause contained in a Dispute Resolution Agreement (“DRA”) that Pelletier signed when applying for a position with Yellow.
