MEMORANDUM OPINION

ELLIS, District Judge.

In this prosecution of three defendants for murder and conspiracy to murder, in violation of 18 U.S.C. §§ 2, 1111 & 1117, the government seeks to introduce at trial as hearsay exceptions under Rule 804(b)(6), Fed.R.Evid., a murdered witness’ statements to her guardian and attorney that incriminate one of the defendants. In support, the government has presented evidence it believes shows that this defendant engaged or acquiesced in wrongdoing that led to the witness’ murder.
