On February 10, 1987, the plaintiffs, Ell-west Stereo Theater, Inc., First Amendment Books and Rodney Skinner, filed this action against Richard Fulton, then Mayor of Metropolitan Nashville, in his official capacity, and the Metropolitan Government of Nashville and Davidson County, Tennessee, seeking a declaratory judgment determining the constitutionality of a Metropolitan Nashville ordinance (Bill No. 086-1549) governing the licensing of adult-oriented establishments.
