On June 18, 2001, this civil matter was before the court for hearing on the motion of the defendant, Fallon Clinic, Inc. (“Fallon”), for summary judgment. See Mass.R.Civ.P. 56. Plaintiff Robert L. Cathey (“Cathey”), a former Fallon employee, filed this action alleging that (1) Fallon discriminated against him on the basis of age in violation of M.G.L.c. 15 IB, §4(1) when it eliminated his position in October of 1995, and (2) Fallon retaliated against him by withdrawing its severance offer because he filed claims against Fallon with the Massachusetts Commission Against Discrimination (“MCAD”).…
