On the 7th day of February, 1844, the defendant, Sylvester Williams, for a valuable consideration, sold, transferred, and delivered to 0. B. Emmons a certificate for one-third of a league of land, issued by the board of land commissioners of Bed Biver county, given on the 1st day of March, *4551888, as Ms headright, and authorized him to locate it in any part of the republic, and call on the proper officer for the title.
