SAFFELS, District Judge.
This matter is before the court on defendant’s motion for an order affirming the Secretary’s decision and plaintiff’s cross-motion for judgment. The case is an appeal from the Secretary of Department of Health and Human Services’ decision denying plaintiff disability benefits under the Social Security Act. Plaintiff filed an application for disability benefits under Title II of the Social Security Act (42 U.S.C. §§ 401 et seq.), which was denied.
