On September 1, 2009, 13-year-old Ashley Davis was hit by a car as she was crossing the street to board a school bus. She died of her injuries two weeks later.

In the Circuit Court for Prince George’s County, the appellants — Ashley’s mother, Nycole Davis, individually and as personal representative of Ashley’s estate, and Ashley’s father, Jerome Bradley — filed a survival suit and wrongful death action, in negligence, against the Prince George’s County Board of Education (“the Board”), the appellee. 1 The appellants alleged that the Board owed a duty of care to provide Ashley a bus stop on…
