This matter comes before the Court pursuant to the Motion to Dismiss Appeals (Doc. # 18) filed by Winn-Dixie Stores, Inc. and its remaining debtor subsidiaries 1 (collectively, “Winn-Dixie”). Winn-Dixie seeks an order of this Court dismissing the appeals of the bankruptcy court’s Order Confirming Chapter 11 Plan of Reorganization of Winn-Dixie Stores, Inc. and Affiliated Debtors (Bankr.Doc. # 12440) entered on November 9, 2006 (the “Confirmation Order”).
