Neely, Chief Justice:

This is an appeal from a decision of the Circuit Court of Ohio County granting a motion for summary judgment. The appellant, the Board of Education of Ohio County, entered into contracts with eight parties for the construction of a new, consolidated high school. After the area surrounding the school building collapsed because the soil could not support construction, all eight parties were named as defendants in a negligence action.
