This is an appeal from a decree entered upon the foreclosure of a trust deed made by Henry C. Ruston, August 13, 1891, to secure a promissory note for $2,500, payable in one year with interest at six per cent per annum, payable semi-annually.

March 24, 1896, a bill to foreclose the mortgage was filed and decree having been entered in such foreclosure suit, an appeal was taken to this court for the October term, 1899, which appeal was dismissed on account of the insufficiency of the bond filed. A writ of error was then sued out,…
