This case is before the court on Plaintiffs motion for summary judgment (Doc. 49) and Defendant’s motion for summary judgment as to liability (Doc. 47). This action arises out of an escrow agreement in which Defendant Broad & Cassel, P.A. (Broad & Cassel) served as an escrow agent. Calusa Trace Development Corporation (CTDC) sold St. Joseph’s Health Care Center, Inc. (St. Joseph’s) a piece of property and agreed to perform certain improvements on the property.
