RONEY, Circuit Judge:
In the first appeal of this case, this Court held that “the unequal application of defendants’ rental criteria, including marital status and employment and credit histories, as between Marable and white applicants demonstrates disparate treatment on the basis of race” in violation of the Fair Housing Act, 42 U.S.C.A. § 3601 et seq., and the Civil Rights Act of 1866, 42 U.S.C.A. §§ 1981 and 1982. Marable v. H. Walker & Associates, 644 F.2d 390, 397 (5th Cir.1981). Judgment for defendant was reversed, and the case was remanded for consideration of damages, attorney’s fees,…
