This is an application by the executors designated in the propounded will which is being contested, for the approval by the court of a proposed compromise agreement between the parties, prior to the probate of the will, and for an order appointing a special guardian for infants and unborn, .pursuant to section 24 *217of the Personal Property Law and section 73 of the Real Property Law. The procedure followed Matter of Bemis (116 Misc. 516).
