The issue before the court is the defendant’s Delaware and Hudson Railway Inc. d/b/a Canadian Railway a/k/a Rail System (herein after defendant) motion for summary judgment.

This case arises from plaintiff’s allegations that he was injured on the job while working as an engineer for defendant. Plaintiff alleges that as a result of these injuries he suffered repetitive stress damage to his cervical, thoracic and lumbar spine.
