This appeal is from a judgment entered on a verdict of murder in the first degree, life imprisonment having been imposed in accordance with the jury’s determination.

The appellant was one of a group attending a birthday party on the night of March 15, 1949, at a private house in Lakewood, New Jersey. He was recently discharged from the Army and carried a semi-automatic pistol of Belgian manufacture. The pistol had a clip containing live ammunition.
