SIMONTON, Circuit Judge.
Thomas Barrett, Jr., a citizen of the state of Georgia, resident in Augusta, desired to develop the water power of the Savannah river above the city of Augusta. To that end he secured the necessary capital, and proceeded to obtain options from owners of land on both sides of the river adjacent to the proposed site of his operations. Whilst he was engaged in securing these options, and after he had succeeded in obtaining some 15 of them, he found that there was another person engaged in the same purpose,—W. H.
