Ransom Aistrop, employed as a coal loader in a mine owned and operated by Blue Diamond Coal Company, Incorporated, in Lee county, Virginia, was found dead at the place of his employment on the afternoon of August 8, 1941. Martha Aistrop, his wife and the administratrix of his estate, filed in the Circuit Court of Lee county a notice of motion for judgment against the Coal Company, seeking to recover damages for the wrongful death of her husband which she claimed was due to the company’s negligence in failing to furnish him a reasonably safe place in which to work.
