This is a civil action in which the plaintiff, the named insured in a homeowner’s insurance policy issued by the defendant Abington Fire Insurance Company (insurer), seeks to be indemnified for damage to her home allegedly caused by the freezing and bursting of plumbing pipes when a faulty oil burner broke down.

The case was tried to a jury in the Superior Court. The trial justice granted the insurer’s motion for a directed verdict on November 26, 1976, and judgment was accordingly entered against plaintiff on November 29, 1976. The case is before us on appeal from this judgment pursuant to…
