This diversity-jurisdiction suit to recover damages for personal injuries was filed in Louisiana more than one year after the automobile accident on which it is based occurred in North Carolina. The defendant conceded liability and sought to negotiate a settlement for an amount the plaintiff considered inadequate. The defendant also stipulated in a formal pretrial order that it was liable to the plaintiff for her injuries and contested only the amount of general damages due her, apparently not contesting reimbursement for her medical expenses.
