The indictment upon which the prisoner was tried and convicted averred that he and one Dora Schernikon feloniously did make an assault upon the prosecutrix and then and there knowingly, feloniously and unlawfully did take her against her will, and with force and arms to compel her by force, menace and duress to be by some person or persons to the jurors unknown defiled, against the form of the statute in such case made and provided.
