DANAHER, Circuit Judge.

The complaint in this action entitled “Complaint To Reform Promissory Note” was dismissed by the District Court and judgment was entered for the appellees. We are satisfied, however, that the appellants had actually stated a claim for declaratory judgment. The issues treated in the record and the evidence adduced by the respective parties demonstrate that the action should have been dismissed without prejudice to its renewal at the proper time.
