The defendant was indicted and convicted for the crime of forgery in the second degree, on the first count contained in the indictment. .This charged that the defendant made, and engraved, and caused and procured to be made and engraved a plate in the form and similitude of a promissory note, issued by a bank at Havana, in the Island of Cuba for the payment of fifty centavos, said bank being a bank incorporated -under the laws of the kingdom of Spain, without the authority of said bank and in violation of the statutes of the state.
