Plaintiffs appeal from a judgment entered dismissing the complaint following a jury verdict in favor of defendant.
The infant plaintiff, Mark A. Gonzalez, was seven years of age on December 16, 1975, when he was struck by a vehicle owned and operated by defendant. The accident occurred in front of plaintiffs’ residence, 100 West 163rd Street, Bronx, New York, between 8:30 and 9:00 a.m. At the time of the occurrence, the infant plaintiff was on his way to school, followed by his older brother Rafael and his younger sister Eileen.
