This is an action for damages brought by the Johns Hopkins University (Hopkins) against James M. Hutton, Jr., et ah, co-partners, doing business as W. E. Hutton & Co. (Hutton). It arises out of the purchase by Hopkins of an oil production payment from Trice Production Co. (Trice), in connection with which Hutton received a commission from Trice. Hopkins claims that Hutton violated certain sections of the Securities Act of 1933, of the Securities Exchange Act of 1934, and of rules adopted thereunder, and is chargeable with common law fraud and negligence.
