This matter comes before the Court on cross-motions for Summary Judgment filed in the above-styled and numbered case. On March 23,1990, A.M. Mancuso, Trustee of the Chapter 11 Estate of Topcor, Inc. (“Trustee”), filed a Complaint against Con tinental Bank National Association Chicago, Successor by Name Change to Continental Illinois National Bank Trust & Company of Chicago (“Continental” or the “Defendant”).
