BUSSEY, Judge:

This is an appeal from the denial of post conviction relief in the District Court, Oklahoma County, Case No. CRF-73-2640, wherein Joe M. Pollard, hereinafter referred to as defendant, was charged with the crime of Robbery in the First Degree, After Former Conviction of a Felony, and plead guilty to the lesser offense of Grand Larceny, After Former Conviction of a Felony, and was sentenced to serve ten (10) years imprisonment. Defendant did not attempt to withdraw his plea of guilty, or file a Writ of Certiorari, but filed for post conviction relief in the District Court,…
