This case comes before the Court on Defendants the City of Atlanta and George Turner’s (the “City Defendants”) motion to dismiss [5] and Defendant James Burns’s motion to stay [17].

I. Factual Background

In June 2016, Deravis Caine Rogers (“Rogers”), the son of Plaintiff Melva Rogers (“Plaintiff’), was shot and killed by Burns, an officer with the Atlanta Police Department (“APD”).
