At the Court’s status conference on January 14, 2010 with the parties in this action, defendant Protective Life Annuity Insurance Company (“Protective”) requested leave to file a motion for summary judgment. The Court directed the parties to submit letter-briefs addressing factual and legal issues raised by Protective’s contention that there are no disputed issues of material fact in this action and that the Court can thus resolve the case as a matter of law.
