—In an action, inter alia, to recover damages for personal injuries and wrongful death, the defendant Ponas Savasatit appeals from an order of the Supreme Court, Queens County (Milano, J.), dated February 17, 1999, which denied his motion for summary judgment dismissing the complaint insofar as asserted against him.

Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the motion which was for summary judgment dismissing the plaintiffs cause of action based on wrongful death and substituting therefor a provision granting that branch of the…
