OPINION

STAPLETON, District Judge:

Donald J. Boyer, the petitioner in this habeas corpus proceeding brought pursuant to 28 U.S.C. § 2254, was convicted by a Delaware State jury on April 10, 1980 of attempted first degree murder, first degree robbery, first degree burglary, second degree conspiracy, first degree reckless endangering, possession of a deadly weapon during the commission of a felony, and possession of a deadly weapon by a person prohibited.
