Henry Lee Clark, as beneficiary, initiated a claim for accidental death benefits against Jefferson Pilot Life Insurance Company (Jefferson), as a result of the death of his son, Donnie Lee Clark, in a one vehicle accident. A blood test was issued after the death of the decedent which indicated that the deceased’s blood alcohol content was .15 percent.
