FACTS
By letter dated March 20, 1995, plaintiff GMRI, Inc., submitted a request under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552, to defendant the Equal Employment Opportunity Commission (“EEOC”) asking for “the entire file on the [Catherine Casanova] charge which is currently in litigation in the United States District Court, Eastern District of New York, Civil Action No. CV 94r-4386.” According to the EEOC, it then requested the Casanova charge file from its Charge Receipt Technical Intake Unit (CRTIU), which maintains the EEOC’s…
