[¶ 1] Gregory Martin appeals from a decision of the Superior Court (Kennebec County, Mar den, J.) affirming a decision of the Unemployment Insurance Commission in which the Commission declined to relieve Martin of his status as an employer. We affirm the judgment of the Superior Court.

I. Background

[¶ 2] Greg’s Place is a small family restaurant located in South China, Maine, owned and operated by Gregory Martin.1 In 1985, a waitress who had worked at the restaurant filed a claim for unemployment benefits.2 At that time, Greg’s Place Was not covered by unemployment insurance.
