Bettie Pullen, joined by her husband, brought this suit against Ida Japhet in her individual capacity, and ■as independent executrix of the will of Isadore Japhet, and as guardian ■of the estate of the testator’s minor children, Dan A. Japhet and Japhet & Company, a corporation, to recover an alleged interest in the property of decedent’s estate, which she alleged had been appropriated by the defendants and was claimed by them as 'their own property, and for a partition of the property, real and personal, of said estate.
