MEMORANDUM DECISION AND ORDER ON COMPETING PLANS OF REORGANIZATION

Before the Court are two competing plans of reorganization, one proposed by the Debtors (as hereinafter described) and the other by the Banks (as hereinafter described). The Debtors’ Plan (as hereinafter defined) is based upon their confidence in their ability to produce cash flows sufficient to support payments to the Banks, pursuant to a proposed restated secured loan, while maintaining the Lender Liability Suit (as hereinafter defined) against these same Banks.
