The plaintiff in error was convicted of criminal libel at the September, 1903, term of the district court for Fron*733tier county, and sentenced to a .term of one year in the state penitentiary. From that judgment he prosecutes error.

It appears that he was the proprietor and publisher of a newspaper published at the village of Curtis in said county, called “The Curtis Courier,” and on the 26th day of June, 1903, published in his said paper the article which was the basis of the prosecution.
