ORDER
NORGLE, District Judge.
Before the court is defendant’s, Mars, Incorporated, motion for summary judgment, pursuant to Fed.R.Civ.P. 56(b), on all counts of plaintiff’s, Mary Muellner, five count complaint alleging retaliatory discharge, breach of contract, age discrimination, intentional infliction of emotional distress, and negligent misrepresentation. For the following reasons, Count III is dismissed and summary judgment is entered in favor of Mars and against Muell-ner on Counts I, IV and V, and on part of Count II.
