Plaintiff, Louis Holiday, brought suit against Defendant, the City of Chattanooga (“the City”), under the Americans with Disabilities Act (“ADA”), 42 U.S.C. § 12101 et seq., and the Vocational Rehabilitation Act of 1973, 29 U.S.C. § 791 et seq., charging that the City refused to hire him as a police officer because he is infect.ed with the human immunodeficiency virus (“HIV”), the virus that causes Acquired Immunodeficiency Syndrome (“AIDS”).
