MEMORANDUM
JAMES N. GABRIEL, Bankruptcy Judge.
Before the Court is the Debtor’s Objection to Allowance of a Proof of Claim in the amount of $28,102.28 filed by Continental Homes of New England (“Continental”). A hearing on the proof of claim and objection was held at which time the parties agreed to all the relevant facts, and submitted documentary evidence by agreement. A Supplemental Agreed Statement of Facts was filed on August 27, 1984. Both parties filed briefs. Based upon the agreed facts and documentary evidence I find the following facts.
