This action of trespass was brought by Morris Borofsky, by his father and next friend Samuel Borofsky, and Samuel Borofsky, in his own right, to recover damages for a grade crossing accident, alleged to have been caused by the negligence of the defendant. The trial in the court below resulted in a verdict in favor of the defendant as to Morris Borofsky, the son, and a verdict in favor of plaintiff as to Samuel Borofsky, the father, presumably for damages to the horse and wagon, of which he was the owner.
