RAMBO, District Judge.

Before the court is defendant’s motion for summary judgment. The motion has been fully briefed and is ripe for disposition.

Background

In Suk Pak is an individual who owns and operates Penny’s Food Market in York, Pennsylvania. Plaintiff was approved for participation in the food stamp program which is administered by the defendant United States Department of Agriculture.
