Certiorari to Dickinson; Stone, J. Case by Stefano Cristanelli, administrator of the estate of Stefano Cristanelli, deceased, against the Saginaw Mining Company for the negligent killing of plaintiff’s intestate. There was an order overruling a demurrer to certain counts of the declaration, and defendant brings certiorari. Affirmed.

This case is before the court upon the re-

turn to the writ of certiorari under the provisions of Act No. 310, Pub. Acts 1905. Suit was commenced by declaration. The defendant filed its plea of general issue to the first count, and, as to the remaining four, filed general and special demurrers to each count. The demurrers were overruled. The defendant filed exceptions.
