On the afternoon of November 7, 1939, plaintiff Colburn was riding in an automobile owned and driven by Lloyd Edwards. The car was moving east on a dirt-surfaced county road, when an automobile driven by defendant Krabill came from the east over the crest of a hill 75 to 100 feet in front of the Edwards car. Plaintiff contended in the court below, and testimony on his behalf tended to show, that the Edwards car was on its right or south side of the road, the right wheel within 2y% feet of the edge of the ditch on the sonth side of the road.
