The plaintiffs in error, Jphn E. Hartenbower and George D. Hiltabrand, for a number of years conducted a bank at Tónica in LaSalle county, and transacted a regular banking business under the name of “Tónica Exchange Bank.” For about 5 years preceding its failure, the bank was in direct charge of George D. Hiltabrand. John E. Hartenbower during that time lived in Chicago, and had an office there, but kept in constant touch with the business of the bank, made frequent visits to Tónica, and at all times was a dominating factor in its management.
