Harriette Bannister, Charles J. Crosby and W. C. Neal v. United States
Court of Appeals for the Fifth Circuit
1Opinion of the Court
JOHN R. BROWN, Circuit Judge:
The appellants Bannister, Crosby and Neal were convicted by a jury under an indictment charging two counts of mail fraud, 18 U.S.C.A. § 1341, and one count of conspiracy to violate the mail fraud statute, 18 U.S.C.A. § 371. 1 Of the several errors asserted on this appeal, only two warrant comment — whether the evidence established that there had been use of the mails within the meaning of § 1341, and whether the District Court erred in refusing to allow Crosby or his counsel access to Crosby’s pre-sen-, fence report. We find no error and affirm.
